The FIR was registered on 22 September at the Parliament Street police station after the Union Ministry of Home Affairs approached Delhi Police with a complaint.

Speaking in the Lok Sabha, Home Minister Rajnath Singh had announced that the Minister of Home Affairs was conducting a probe into the circumstances under which the second affidavit and some documents in the Ishrat Jahan case had gone missing.

After this, an inquiry panel set up to probe the missing documents from the Ishrat Jahan case had claimed that former Home Secretary GK Pillai knew of the changes made in the second affidavit relating to the case which was to be filed before Gujarat High Court.
