2 Congress MPs Move SC Against Rejection of CJI Impeachment Notice

Two Congress MPs on Monday, 7 May, moved the Supreme Court against the Vice-President’s rejection of the impeachment notice filed by the opposition.

According to News18, Rajya Sabha MPs Pratap Singh Bajwa and Amee Harshadray Yajnik, in their petition, termed the Vice President’s dismissal ‘arbitrary and illegal’.

The petition was taken up in the court by senior party leader and lawyer Kapil Sibal, who has reportedly sought the setting up of a judges’ inquiry committee to probe the charges that have been leveled against Chief Justice of India Dipak Misra.

Listing the matter for urgent hearing before Justice J Chelameswar, Sibal reportedly told the Justice that the CJI should not be allowed to hear the case nor decide who will hear it.

According to News18, Justice Chelameswar has asked Sibal to appear again on Tuesday, 8 May, regarding the matter.

Rajya Sabha Chairman and Vice President M Venkaiah Naidu had rejected the notice given by 64 members of the Rajya Sabha from Opposition parties, led by the Congress, to impeach CJI Dipak Misra on 23 April, citing a lack of substantial merit.

Naidu reportedly held extensive consultations with top legal and constitutional experts, including former chief justices and judges, before taking the decision.

Earlier last month, the opposition parties led by Congress had moved the notice before him to impeach the CJI on five grounds of "misbehaviour".
