Cong Demands Probe Into Loya’s Death, Says It Affects Democracy

The Congress party, in a press conference on Monday, 15 January, demanded a probe into Justice BH Loya’s death, stating that it impinged on a “vital organ of the democracy”.

Addressing the media, Congress leader Abhishek Singhvi said that probe into the judge’s death does not depend on his family members but by “responsible stakeholders”.

If a matter impinges on a vital organ of democracy like this then the demand for enquiry is a demand by responsible stakeholders and is not dependent on whether family member A wants it and family member B does not want it.

Singhvi pointed out instances as told by Loya’s sisters and said that there are certain inconsistencies in the facts surrounding his death.

In an earlier press conference, on 12 January, party president Rahul Gandhi also called for an “impartial investigation” into the death of the judge.

Justice Loya’s death needs to be investigated properly at the highest level of the Supreme Court. The party unanimously believes that an impartial investigation needs to be conducted by a Special Investigation Team (SIT) under the eyes of senior-most Supreme Court judges.

A statement released by the Congress, on 12 January, stated that the observations made by the judges have far-reaching consequences and may jeopardise the independence of the judiciary and the democratic fabric of the country. Gandhi cautioned that “this threat to democracy needs to be looked into” since citizens who value the idea of justice and who repose faith in the Supreme Court are looking at the matter.

The issue recently resurfaced when four Supreme Court judges held an unprecedented press conference, expressing unhappiness at the functioning of the Supreme Court and alluding to Judge Loya’s death.

A petition is currently filed in the Supreme Court seeking a probe into the death of Justice BH Loya and arguing that his demise was “motivated.”
