Nirbhaya’s Mother Moves SC Opposing Review Plea of Convict

The mother of Nirbhaya, the victim in the 2012 Delhi gang rape and murder case moved the Supreme Court on Friday, 13 December, opposing the plea filed by one of the four death-row convicts seeking review of the SC’s 2017 judgment awarding him death penalty, PTI reported.

The counsel, appearing for Nirbhaya’s mother, said they are opposing convict Akshay Kumar Singh’s review plea, which is scheduled to be heard by a three-judge bench on 17 December.

The apex court had on 9 July last year dismissed the review pleas filed by the other three convicts – Mukesh (30), Pawan Gupta (23) and Vinay Sharma (24) – in the case, saying no grounds have been made out by them for review of the 2017 verdict.

Plea Seeking Issuance of Death Warrants Deferred

Earlier on Wednesday, a Delhi court said that it will hear on Wednesday a plea seeking issuance of death warrants against the four convicted in the case.

Additional Sessions Judge Satish Kumar Arora on Friday deferred the matter till 18 December, noting that the review petition of one of the convicts was pending before the Supreme Court for Tuesday, according to PTI.

“At least, I have to wait till the time appeal for review is pending,” the judge said.

"My view is that once the review is pending before before the SC, let's wait for the outcome," the judge said.

"Since his (Akshay Kumar) review petition is pending before SC for 17 December, I would adjourn it for 18 December."

Urging the court to issue death warrants, the prosecution said: "The court can issue death warrant. Nothing prevents court from issuing death warrants."

‘Will Keep Fighting for Justice’

Asha Devi, Nirbhaya’s mother, on Friday, said she wants those convicted in the case to be hanged on 16 December, the day her daughter was brutally raped and assaulted and left to die on the road seven years ago, according to PTI.

The mother said she will keep fighting for their execution till she is alive. The case will be heard on 17 December.

“When we have fought for seven years, we can wait for another week. On 18 December, their (convicts in the case) death warrant will be issued,” she said.
