Man Removes Condom During Sex, Convicted for Rape by Swiss Court

The court said that the woman would have refused sex had she been informed that a condom would not be used.

A man in Switzerland has been convicted of raping a woman after he took off the condom without his partner’s consent, Independent reported.

The Criminal Court in Lausanne, Switzerland passed the landmark verdict, determining that sex without a condom constituted rape if the use of one was expected.

The 47-year-old man from France was given a 12-month suspended sentence on Monday.

The unnamed man and woman met through Tinder. On their second date in June 2015, they had sex with a condom but the woman realised it was off only after they got done.

The court said that the woman would have refused sex had she been informed there would be no condom. The woman’s lawyer called the case and ruling “a first for Switzerland”.
