Children are often dragged to the court for the custody battle of their parents. In many cases, they are so small that they don’t know what is happening. Can children choose which parent they want to live with?

“Why don’t you come and stay with mother? Can’t you tell the court that I used to live with you and still want to do so?” A teary-eyed, six-year-old asked her father in Calcutta High Court on Tuesday.

Seeing her cry, her little brother also began sobbing. “If she stays with dad, I will also go with her,” he blurted out as tears rolled down his cheeks, reports The Times of India.

This heart-wrenching family drama left the lawyers and the petitioners struggling for words.

In 2012, the wife began to suspect her husband and decided to leave with her children. After failing to get either his wife or the kids back, the husband moved the court seeking custody of the children. The wife too then filed a counter-petition for custody.

On Tuesday , the court said both children would stay with the mother until the next court order.
