The Central government has submitted an affidavit to the Supreme Court to make commercial surrogacy illegal. According to a report in IBN Live, the affidavit further states that in the case of infertile, married couples altruistic surrogacy would be allowed.

The concerned authority will give a go-ahead only after assessing the needs of the couple. Commercial surrogacy service would be deemed illegal and appropriate penalty would be applied.

If this gets implemented, no foreigner would be able to avail surrogacy services in India and there would be no import of embryo for surrogacy purposes. Any couple who fails to take custody of a child born with disabilities through surrogacy will be penalised as per the affidavit.
