Law Commission is Engaging in Illegal Activities: Muslim Law Board

The board’s comments came days after Centre opposed triple talaq and supported uniform civil code in Supreme Court

The All India Muslim Personal Law Board (AIMPLB) on Thursday rejected the Law Commission's questionnaire on Uniform Civil Code and decided to boycott it.

This came days after the union government told the Supreme Court that Triple Talaq, Nikaah Halaal and polygamy were not integral to the practice of Islam or essential religious practices.

Members of the Muslim Personal Law Board, while opposing introduction of a uniform civil code, slammed the government and the Law Commission on Thursday.

The board’s statements came in the light of the Centre’s move in the Supreme Court opposing the practice of triple talaq. Besides, the Law Commission had sought public response on whether triple talaq should be abolished and whether a uniform civil code should be optional.

Hazrat Maulana Wali Rehman, member of the board, said that the Commission is working in the government’s interest and not functioning as an independent body.

He further added:

Uniform Civil Code is divisive and will lead to social unrest. It is against the spirit of the Constitution, which safeguards the right of citizens to practice their culture and religion. Uniform Civil Code is not good for this nation. There’re so many cultures in this nation and they have to be respected.

The board members also said that “India is blindly following the US without appreciating the federal system there”.

Calling for the boycott of the Law Commission, the Maulana said:

The Law Commission is not functioning like an independent body, it is engaging in illegal activities and acting like the government’s agent. Therefore, we have decided to boycott the questionnare sent by the Law Commission.

Jamaat-e-Islami Hind (JIH) president Maulana Arshad Madni, who was at the briefing, commented:

The Muslim Personal Law is based on Quran and Hadith and we cannot alter it. Modiji (Prime Minister Narendra Modi) wants to impose dictatorship in the name of democracy.
