Govt Attempted To Shield Accused: HS Phoolka on 1984 Riot Case

On the day Delhi High Court sentenced life imprisonment to Congress MP Sajjan Kumar for his involvement in the 1984 anti-Sikh riots, key petitioner HS Phoolka said that there was systemic attempt by the government and machinery to shield the accused.

Speaking to BloombergQuint, Phoolka said, “The case started 21 years after the riots in 2005. Police, judiciary, administration are responsible for delaying the process,” adding that the Supreme Court will not entertain a review petition, if Sajjan Kumar happens to file one.

Phoolka said that it is a great victory not only for the victims but for the whole nation. He however said that justice hasn’t yet been done completely.

“Justice has not been done at all. It's a symbolic justice. Despite all attempts from powerful people, even symbolic justice is enough,” he said.

Phoolka also reacted upon Congress’ decision of appointing Kamal Nath as the chief minister of Madhya Pradesh. Some eye witness acounts have accused Kamal Nath of being involved in the riots.

“There is strong evidence against Kamal Nath. We have been presenting it to the courts, but no case has been registered. This judgement strengthens our case and we hope SIT will now register a case against Kamal Nath”

He said that the court’s decision should be seen as a message for those who commit crimes like lynching, terming the judgement relevant in today’s context.
