What’s Next For Those Who Were Left Out of the Assam NRC Draft?

Out of the 3.29 crore people who had applied for the NRC in Assam, only 2.89 names were included in the draft list.

Out of the 3.29 crore people who had applied for the National Register of Citizens or NRC in Assam, only 2.89 names were included in the completed draft list. More than 40 lakh names didn’t make it to the final draft.

But that doesn’t mean that their names have been completely rejected by the NRC or they have been declared illegal foreigners living in Assam.

These 40 lakh people have a legal right now to apply again for the NRC by filing claims. Starting 7 August 2018, they can find out the reasons for their exclusion by going to NRC Sewa Kendras and the local registrars.

They will be told why their names were not included. The reasons could be many, like spelling errors, lack of documents to establish relationships and family tree, ineligible documents, etc. Applicants will be asked to submit additional or correct documents and details.

From 30 August to 28 September these 40 lakh people can apply again for the NRC.

They can provide correct legacy data, documents like passports, land records, bank passbooks, marksheets, birth certificates etc to claim their right for inclusion in the NRC.

The final NRC is expected sometime in December 2018. People who find their names missing from the final NRC can approach the foreigners’ tribunal and the Supreme Court of India.

Bulk of the people whose names have been put on hold are people who have been identified as D Voters by the Election Commission and their descendants. Such cases are handled by the foreigners’ tribunal and the FT almost works in tandem with the NRC.

If any person is declared a foreigner by the Foreigners’ Tribunal. And his name has been included in the NRC, then that person’s name can also be removed after the verdict is out.

Before the publication of the final NRC if it is discovered that a person’s case is pending in the foreigners’ tribunal then that person’s name in the NRC will also be put on hold.

And finally if a person’s name was not included in the draft NRC because a case is pending against him in the foreigners’ tribunal.

But eventually the tribunal delivers a verdict in his favour declaring that the person is an Indian.

Then the NRC will have to include that person’s name in the final list.
