A couple from Texas has sued Apple, claiming that their minor daughter was killed in a car crash that was caused by a driver who was distracted by the tech giant’s FaceTime video chatting app.
The lawsuit, filed this month in Santa Clara Superior Court, accuses Apple of not implementing the iPhone features that would automatically disable FaceTime based on technology that calculates highway speeds.
The victim, 5-year-old Moriah Modisette, was killed in an accident near Dallas on 24 December 2014. The lawsuit obtained by California television KTLA claims police found FaceTime running on the iPhone of the driver who struck the car the Modisette family was travelling in at a speed of 65 mph.
The family claims Apple knew the risks of using FaceTime while driving because the company patented the "lock-out" technology in 2008.
Apple hasn't responded to the lawsuit. It’ll be interesting to see Apple’s take on the matter, when the case is heard at the Santa Clara Superior Court in the coming weeks.
