SC Allows Nestle to Destroy 550 Tonnes of Expired Maggi Noodles

Nestle India had on 21 September sought the apex court’s approval for destroying 550 tonnes of Maggi stocks.

The Supreme Court on Monday gave its nod to Nestle India and FSSAI to destroy 550 tonnes of recalled stocks of Maggi noodles which have passed their shelf life and are in the possession of the company and the food regulator.

A bench of justices Dipak Misra and UU Lalit said the stock which is stored at 39 locations of the company across India and the stock which is with Food Safety and Standards Authority of India (FSSAI) at Lucknow shall be destroyed as per the agreed procedures between both the parties.

Nestle India had on 21 September sought the apex court’s approval for destroying 550 tonnes of the concerned Maggi stocks.

As Senior Counsel Harish Salve moved the plea before a Bench of Justice Dipak Misra and Justice C Nagappan, the Food Safety and Standards Authority of India (FSSAI) contended it needed to be consulted on this.

As the FSSAI counsel raised an earlier issue of the destruction of evidence by Nestle, Salve told the court this was an old allegation that was raised before the High Court.
