SC Dismisses Sri Ram Sene Chief Muthalik’s Plea on Entering Goa

The Supreme Court bench dismissed Muthalik’s petition and asked him to return six months later.

A plea by Sri Rame Sene Chief Pramod Muthalik was dismissed on Monday by the Supreme Court. Muthalik’s petition challenged a Bombay High Court decision to uphold an order against him and his aides banning them from entering the territory of Goa.

The Bench of Judges Said:

The bench comprising Chief Justice HL Dattu and Justice Amitava Roy had rejected Muthalik’s plea. Here’s what they said.

  • The order might have been passed to maintain peace in Goa.
  • The people of Goa will take care of their interest. What are you doing? You people are simply doing moral policing.
  • Sri Ram Sene activists barged into a pub and beat up boys and girls.
  • We are sorry for the time being. Come back after six months.

On July 2, a Goa bench of the Bombay High Court refused to interfere with the prohibitory order imposed on him and his associates by the state police.

Pramod Muthalik’s Claims

  • The prohibitory order passed under section 144 of the CrPC was illegal.
  • It was repeatedly passed without giving him a hearing.
  • It was a violation of his fundamental rights and the High Court order was clearly erred in law and facts of the case.
  • The repetitive prohibitory orders passed by the Goa government and district magistrates of South and North Goa are “illegal and without jurisdiction”.

Pramod Muthalik had sought ex-parte permission to visit Goa. An ex-parte decision is one given by a judge without consulting all parties involved.

The first order restraining Muthalik from entering the state was issued by the district magistrates of North Goa and South Goa on August 19, last year for 60 days. The orders were subsequently extended further.
