Hold on, Guys! Chandigarh Isn’t Really Banning Mini Skirts in Pubs

The new policy will ensure a firmer hold on bars and restaurants.

Discotheques have been added to the list of places that are breeding grounds for anti-national elements by Chandigarh bureaucrats. The state government has introduced a new policy called ‘Controlling of Places of Public Amusement’, 2016.

This policy led to much media furore about Chandigarh allegedly banning women wearing mini skirts to discotheques. However, the policy makes no direct claim to women’s clothing except for a clause that bans “exhibition or advertisement whether by way of posters or in the newspapers, photographs of scantily dressed women”.

Some of the other clauses of the policy include:

Power of Refusal of Permission Certificate for Operation of Business: The Nodal Office may refuse issuance of fresh permission certificate or revoke the existing permission certificate for operation of business, irrespective of the facts that the organiser has obtained the requisite permission from all the respective Departments if it is considered:

  • To be indecent or of a scurrilous character;
  • To contain offensive reference to personalities;
  • To wound the susceptibilities of any nation or followers of any religion;
  • To be seditious or to be likely to excite political discontent;
  • To promote hostile feelings between different classes;
  • To be calculated to cause a breach of the peace;
  • Any performance or game involving risk, damage or danger to the audience or public;
  • Any exhibition or advertisement whether by way of posters or in the newspapers, photographs of scantily dressed women;
  • The Nodal Office shall not be bound to state the reason for refusing any permission certificate.

The policy brings in strict regulations for what it describes as “commercial enterprise running for pecuniary gains”. The list of the said enterprises includes discotheque, pool or virtual reality game machine parlours and bowling alleys.

The organisations or places falling under this category, according to the official statement, include, any place that involves “music, singing, dancing (excluding cinema) and facility of eating and consumption of alcohol are provided to the customers or patrons in the prescribed premises/area, with the purpose of running a commercial enterprise for pecuniary gains”

The Monitoring Committee shall be responsible for monitoring of the operation of places of public amusement by way of inspection and shall report to the Chairman on a monthly basis or as sought by the Chairman.

According to a Times of India report, Punjab and Haryana high court had ordered the Union Territory (UT) administration to ensure a firmer hold on bars and restaurants in the city in the wake of reports of series of brawls and incidents of violence outside the discotheques.
