Yakub Memon Might Not Be Hanged Yet; He Still Has Options

The Supreme Court has dismissed the curative petition of death row convict Yakub Abdul Razak Memon in the 1993 Mumbai serial blasts case.

Memon, a key conspirator with Dawood Ibrahim in the 1993 Mumbai serial blasts case, is one of ten convicts who was given the death penalty by a special TADA court.

His death sentence was upheld by a Supreme Court bench on March 21, 2013.

If the execution is carried out, it will be the first in connection with the violence that rocked Mumbai resulting in the death of over 250 people in 1993.

Options Before Yakub Memon

A source from within the Death Penalty Research Project at the National Law University in New Delhi, says Memon still has the following options:

  • File a second mercy petition. The first petition had not been filed by Memon himself, and it did not raise all the relevant grounds. This source says, since all judicial remedies have been exhausted, this would be the appropriate time for him to file another petition.
  • Challenge the ‘black warrant’, which is the warrant setting the date for hanging for procedural violations.
  • Challenge the rejection of the mercy petition by the President and seek commutation.
