Make Stalking a Non-Bailable Offence

Did you know that stalking is a bailable offence in Indian criminal law? This allows stalkers to get bail without serious scrutiny, often putting the victims at further risk, including acid attacks and murder.

The Quint has collaborated with senior advocate Kamini Jaiswal and Member of Parliament Dr Shashi Tharoor to draft and submit a Bill in Parliament to make stalking a non-bailable offence.

CASE: Timeline of How Priyadarshini Mattoo was Stalked and Eventually Murdered

  • Feb 25, 1995 Santosh Singh follows Priyadarshini Mattoo's car on a motorbike and tries to stop her. Lodges a complaint.
  • Aug 16, 1995 Mattoo files another complaint against Santosh after he tries to break into her residence.
  • Oct 27, 1995 Mattoo files a complaint with the dean of Delhi University's Campus Law Faculty.
  • Oct 30, 1995 Santosh lodges complaint with DU authorities against Mattoo stating that she was simultaneously pursuing two courses
  • Nov 1, 1995 Mattoo is issued a show-cause notice by Delhi University authorities.
  • Nov 6, 1995 Mattoo files a fresh complaint against Santosh for trying to hold her arm and harassing her on the campus.
  • Jan 23, 1996 9 am: Personal security officer Rajinder Singh, who had been assigned security of Mattoo does not reach her house on time.

  • Jan 25, 1996 Case handed over to the CBI. Agency registers case.
  • Apr 11, 1996 CBI files chargesheet in the case against Santosh Singh.
  • Aug 11, 1997 Trial starts in the court of Additional Solicitor General S C Mittal.
  • Jan 3, 1998 Prosecution evidence closes. Fifty witnesses examined by the court. No Defence witness.
  • Apr 18, 1998 Arguments closed in the case but was marred by a controversy of allegations of money changing hands ahead of judgement. Case transferred to trial court.
  • Dec 3, 1999 Trial court delivers judgement, Santosh Singh acquitted.
