Weinstein Sues Former Company for Access to Personal Documents

The producer is suing The Weinstein Company to access his personal files and emails, so he can ‘defend’ himself.

Former Hollywood Producer Harvey Weinstein has filed a lawsuit against his former employer, The Weinstein Company, for access to his phone records, email and personnel file, that he reportedly needs to defend himself against a series of sexual harassment allegations.

The suit was filed by his lawyer, Patricia Glaser, in Delaware on Thursday.

The lawsuit also says that the lawyers for the company have not allowed Weinstein access to his personal documents, and that are instead leaking some of the information in them to the press. To this end, the lawsuit added that Weinstein should be granted access to his personal documents in order to pursue claims against the company of “mismanagement by leaking confidential company information”.

Weinstein’s access to his email – hw357@weinsteinco.com – was blocked right after he was expelled from The Weinstein Company, three days after the allegations of sexual harassment against him began to surface in the media. Since 5 October, over 60 women have come forth with their own experience of being sexually harassed or assaulted by the producer.

According to the lawsuit, if Weinstein is given access to his email, he can make preparations to exonerate himself.

Mr Weinstein believes that his email account – which is the primary, if not only, account he used during the term of his employment by the Company – will contain information exonerating him, and therefore the Company, from claims that may be asserted against him or the Company.

The lawsuit also looks to protect Weinstein’s ‘financial interests’ in the company. If the company is forced to pay out large sums of money to settle allegations, which according to Weinstein, have not been proven considering the investigation is still ongoing, the latter’s interest as a Member will suffer.

Glaser filed the lawsuit a few days after issuing a subpoena to the company, seeking access to personal documents, as part of an inquiry into whether company officials themselves violated state civil rights law.
