Justice Chelameswar Sticks With Convention on Last Day in SC

Justice Chelameswar had earlier declined an invitation from the SC Bar Association for his farewell function.

Contrary to earlier reports which claimed that the second senior-most judge of the Supreme Court Justice J Chelameswar will not be sitting with the Chief Justice of India (CJI) Dipak Misra on his last working day, it has now been noted that Justice Chelameswar did follow convention. Convention dictates that a judge sits with the CJI just before retirement.

An NDTV report claimed the cause list of the apex court for 18 May stated that Justice Chelameswar would be sitting with Justice Sanjay Kishan Kaul in court number two, and not with CJI Misra in the first court.

The retirement date for Justice Chelameswar is 22 June, but since the court is heading for a summer vacation, his last working day would effectively be 18 May.

Notably, Justice Chelameswar was one of the four SC judges, along with Justices Ranjan Gogoi, MB Lokur and Kurian Joseph, who had called for the unprecedented press conference on 12 January, in which a litany of allegations were made against the CJI.

Last week, SCBA President Vikas Singh said the bar body had met Justice Chelameswar to invite him for the farewell on 18 May, which is the last working day of the Supreme Court before the summer vacation.

“He declined the invite for the farewell function,” Singh had told PTI.

He said the members of the executive committee of SCBA had once again tried to persuade him to attend the farewell function but the judge did not agree, citing personal reasons.

Correction: An earlier version of this article quoted an NDTV report that said Justice J Chelameswar was not going to sit with the CJI on his last day. The error is regretted.
