Aarushi Murder Case: Talwars Reach Home After Four Years in Jail

The Allahabad High Court on 12 October acquitted Rajesh and Nupur Talwar, parents of Aarushi Talwar, in the 2008 murder of their daughter and domestic help, Hemraj. The High Court struck down a 2013 CBI court order convicting them for the murder of their daughter, Aarushi, and domestic help, Hemraj.

The Talwars were released from Ghaziabad's Dasna Jail on 16 October, three days after they were acquitted.

We Never Lost Hope: Talwar's Family Lawyer

The family lawyer of the Talwars, Tafeeq Ahmad Mir, said the verdict of the Allahabad High Court establishes the innocence of his clients. He said Rajesh and Nupur Talwar never lost hope in the justice system, and requested the media to let them live with dignity from now on.

Mir said that even in Dasna jail, nobody ever doubted the innocence of the Talwar couple.

Vandana Talwar, a relative of Rajesh and Nupur Talwar said she is extremely grateful to the Allahabd High Court for the verdict. She said she is happy that the Talwars are coming back home with fully dignity.

Talwars Likely to Live in Jalvayu Vihar Again

Rajesh and Nupur Talwar are likely to go to Nupur's father's home in Jalvayu Vihar, Noida, the complex they lived in when their daughter Aarushi was murdered, after their release from Dasna jail on Monday, 16 October.

Aarushi and the Talwars' domestic help, Hemraj, were found dead at their home in L-32, Jalvayu Vihar, in May 2008. The house has now been rented out.

After their release, Rajesh and Nupur will go to Sector 25, Jalvayu Vihar, where I own a house.

Talwars to Visit Dasna Every 15 Days

Jail doctor Sunil Tyag, echoing Dasna jailor D Maurya’s earlier statement, said that Nupur and Rajesh Talwar have assured the authorities that they would visit the prison every 15 days to check-up on its inmates.

According to jail authorities, there has been a sudden rush of patients who are in a “hurry” to get treated by the couple.

Jail Superintendent Dadhiram Maurya added that the amount of remuneration refused by the dentist couple amounted to approximately Rs 49,500.

Talwars To Visit Dasna Periodically to Provide Medical Assistance

Dasna Jailor D Maurya said that there was a “strong possibility” of Rajesh and Nupur Talwar being released today. He added that the Talwars will continue to visit the jail periodically to provide medical assistance.

Talwars will continue to visit jail periodically so that medical assistance provided by them to inmates can continue.

He added that they provided medical service for free, and refused remuneration. According to him, their remuneration would have been Rs 49,500, had they agreed to take it.

The jail authorities had also requested the Ghaziabad district administration to give security cover to the couple till the time they reach home.

D Maurya, the jailor of Dasna Jail, however, said that the Talwars will not be released till they receive the court order.

The night of 14 May 2008 changed the fate of L-32 Jalvayu Vihar, Noida, forever, bringing the two-bedroom flat under an oppressive media glare.

Nine years later, on a day the couple who owned the flat was cleared of the ignominy of being their daughter's murderers, Aarushi Talwar remains a forbidden topic for the residents of the neighbourhood.

An eerie silence hung over the apartment complex, inhabited by retired air force and naval officers, with neighbours reluctant to talk about the sensational murder case, which continues to remain a mystery.

Nupur and Rajesh Talwar had moved out of the flat after the incident, renting it out. They had shifted to South Delhi's Hauz Khas.

A neighbour, Ashish, was among the very few who spoke about the murder of the couple's teenage daughter and Nepalese domestic help Hemraj. "No parent can do this to their child," he said before retreating into his L-Block house.

The Nepalese domestic helps here made no bones of where their sympathies lay.

The rich can get themselves acquitted. In the Nithari case too, (Moninder Singh) Pandher was acquitted. The poor cannot expect justice.

A washerwoman, who has been running her shop near the Talwar apartment for nearly 25 years, said the couple had not been spotted in the area since the fateful summer night.

"HC Said Exactly What We Did in Closure Report": Ex-CBI Director

Speaking to The Quint, former CBI director Amar Pratap Singh said:

The High Court has said exactly what we said in our closure report – that there isn’t enough evidence to prosecute the parents. We said that due to lack of direct evidence, and merely on the basis of the circumstantial evidence, the CBI is unable to file a chargesheet in the case. But, the court took cognisance of our closure report and ordered a trial against the parents. I have not read the HC judgment, but media reports say that the parents are acquitted on the benefit of doubt, which means lack of evidence. The crime scene was completely botched up by the Uttar Pradesh police, especially the room where Aarushi’s body was found. We couldn’t collect enough fingerprints, which could’ve been a major lead in nabbing the murderer.

Speaking to ANI later, Singh said:

It is not really a clean chit because it says benefit of doubt, and not that they are innocent.

Will Approach SC, Says Rajkumar's Lawyers

Rajkumar’s lawyer, Naresh Yadav, said his client is unhappy with the judgement and that they will approach the Supreme Court. Rajkumar was the house help at Dr Anita Durrani’s, one of Talwars' friend. He was at the Talwar residence drinking with Hemraj and compounder Krishna on the night of the murder.

Dasna Jail Waiting to Hear From Court

The Dasna Jail super said the Talwars will be released within half an hour of the jail receiving papers from the court.

After having breakfast, they were praying. Their schedule was normal. She (Nupur Talwar) said they got justice today and had tears of joy. Any person after spending so much time in jail will feel happy to get freedom. So, they were happy after they were told about the news.

Verdict Expected at 2:45 pm

The Allahabad High Court is expected to deliver its verdict at 2:45 pm, in the appeal filed by Rajesh and Nupur Talwar, challenging a CBI court order convicting them for the murder of their daughter Aarushi and domestic help Hemraj in 2008.

Fourteen-year-old Aarushi was found dead inside her room in the Talwars’ Noida residence with her throat slit in May 2008. The needle of suspicion had initially moved towards 45- year-old Hemraj, who had gone missing, but his body was recovered from the terrace of the house two days later.

As the Uttar Pradesh Police drew flak over shoddy investigation into the case which was making national headlines, the then Chief Minister Mayawati handed over the probe to the Central Bureau of Investigation (CBI).

Aarushi Murder Case: A Brief Timeline

16 May 2008, changed the lives of the Talwar family forever. Their only daughter, 13-year-old Aarushi was murdered. Two days later, their servant, 45-year-old Hemraj, who they believed had killed Aarushi, was also found dead on the terrace. In a house where there were four people, the court ruled that since there was no evidence of outside intrusion, the two dead were killed by Rajesh and Nupur Talwar.

From May 2008 till November 2013, the Talwars’ every move, mood, expression and statement was closely watched, dissected and talked about by the entire nation. The Aarushi-Hemraj murder became the most sensational crime to be covered by a 24/7 media.

Since the Talwars started serving their life sentence in the Dasna Jail, on the outskirts of Delhi, Rajesh runs a fully organised dental clinic inside the jail, where Nupur also works occasionally.
