SC to Consider Yakub Memon’s Plea Against Death Warrant Tomorrow
SC has agreed to hear Yakub Memon’s plea against the death warrant which, the latter claims, was issued in haste.
The Supreme Court has agreed to a detailed hearing of Yakub Memon’s plea against the death warrant issued against him. Memon has pleaded that the warrant was issued in haste. The hearing, which began today, will resume on Tuesday at 10:30am.
A writ petition filed by Yakub challenges the validity of the death warrant issued against him by a TADA court in Mumbai.
The bench consisting of Justices A R Dave and Kurian Joeph, is also considering a plea filed by Delhi’s National Law University (NLU), which through its Death Penalty Litigation Clinic has intervened in the case and supported Yakub’s contentions against the death warrant.
Yakub’s plea is that the death warrant was issued in the last week of April, before he could file a curative petition. Yakub’s review petition had already been dismissed but the apex court had held earlier this year that a death warrant should not be issued till the convict has exhausted all legal remedies.
