Watch: SCBA Passes Two Resolutions In a Bid to Diffuse Tension

The implication? If resolution is accepted, the investigation into Judge Loya’s death would be transferred.

The Supreme Court Bar Association held a press conference on Saturday to discuss the letter drafted by four judges of the Supreme Court to the Chief Justice of India regarding their concerns with allocation of cases.

In what appears to be an attempt to heal the rift between the judges, the SCBA unanimously passed two resolutions.

We will send the unanimous resolution to the Chief Justice of India. We want that the matter be resolved as soon as possible.

What Are The Two Resolutions?

Firstly, they urged the judges to conduct a ‘meeting of the full court’ at the earliest to resolve the issues raised by the four senior judges, including allocation of cases and even the memorandum of procedure for appointment of judges.

Such a meeting would involve all the 25 judges of the Supreme Court sitting together in closed proceedings to discuss these issues, and it would not allow public access.

Secondly, they recommended that all PILs be heard by the benches headed by the five senior-most judges of the Supreme Court – the courtrooms of the CJI and the next 4 senior-most judges (courtrooms 1-5).

If accepted by the apex court, this would mean that the petition asking for a special investigation into Judge Loya’s death would be transferred from courtroom 10 where it is currently listed (Justices Arun Mishra and MM Shantanagoudar) to the courtrooms of either CJI Dipak Misra, Justice Chelameshwar, Justice Gogoi, Justice Lokur or Justice Joseph. The latter four are the judges who wrote the letter.

Differences stated by the four judges and reflected in media are of grave concern and must be resolved immediately.
