Plea Filed in SC Seeking CJI Misra’s Recusal from Bofors Case
The petition has been posted for hearing on 2 February.
Supreme Court lawyer Ajay Aggarwal filed a petition in the apex court seeking Chief Justice of India Dipak Misra’s recusal from the Bofors case, on the grounds that he acted in a biased manner on 16 January and allowed ex-law minister Kapil Sibal to intervene without any authority, despite repeated objections.
The petition has been posted for hearing on 2 February.
According to ANI, the top court on 1 January questioned Aggarwal on his capacity to file a petition in the case.
Aggarwal, also a BJP member, had then filed a plea seeking an early hearing in the Bofors scam case. He also petioned against the Delhi High Court's 2005 judgement, which had written off all charges against the Hinduja Brothers in the case.
The court also said that it would "be against criminal jurisprudence to permit a third party who is not connected to the case", reported ANI.
Aggarwal's plea comes a day after Attorney General KK Venugopal told the government that the CBI should not file a special leave petition (SLP) in the Bofors case against 2005 Delhi High Court judgment discharging Hinduja brothers.
