The Supreme Court on Wednesday, 22 January made it clear that it will not grant any stay on the Citizenship Amendment Act (CAA) without hearing the Centre and said it may refer pleas challenging the validity of the Act to a larger Constitution bench.
It barred the high courts from passing any orders related to the Act till it decided on the matter.

Delhi HC Directs Police to Look Into Road Restrictions on Shaheen Bagh Stretch
Amid the anti-CAA protests, the Delhi High Court on Tuesday, 14 January, directed the police to take a call on the re-opening of Kalindi Kunj-Shaheen Bagh stretch.
The Kalindi Kunj-Shaheen Bagh road stretch has been closed since 15 December 2019.
Daryaganj Violence: Court Slams Delhi Police Over Azad’s Arrest, Verdict on 15 Jan
Delhi's Tis Hazari Court on Tuesday, 14 January, adjourned the hearing in Bhim Army Chief Chandrasekhar's bail plea in the Daryaganj violence case till Wednesday, so that the state can produce all FIRs registered against him in Saharanpur.
While hearing the bail application the court slammed the Delhi Police and said, “ You are behaving as if Jama Masjid is Pakistan. Even if it was Pakistan, you can go there and protest. Pakistan was a part of undivided India.”
DMC Appeals to CJI to Take Cognizance of Alleged Police Brutality Against CAA, NRC Protesters
Delhi Minorities Commission (DMC) has appealed to Chief Justice of India SA Bobde to take cognizance of the alleged police brutalities during recent protests against the CAA and the NRC in various parts of the country.
DMC Chairman Zafarul Islam Khan, in a letter to the CJI, said police behaviour in various states has been "highly objectionable" during the protests against CAA NRC.
Khan in his 10 January letter has attached a list of 87 instances of "police brutality" against protesters in UP, Karnataka, Assam, Jammu and Kashmir, Gujarat and Delhi.

Protest Against CAA, NRC in East Delhi's Khureji
Over a thousand people on Tuesday, 14 January, gathered in East Delhi's Khureji neighbourhood to protest against the amended citizenship law and a possible pan-India National Register of Citizens.
Raising slogans of "Aazadi", "Inquilab Zindabad" and "Aawaaz do hum ek hain", an estimated 1,500 people, including women and children, gathered for the second day at a local park.

A suo motu case has been registered against 150 unidentified people after Left students' activists “gheraoed” West Bengal Chief Minister Mamata Banerjee at an anti-CAA rally in Kolkata on 11 January, PTI quoted sources as saying on Wednesday.
The case includes non-bailable sections of causing damage, criminal intimidation, as well as assaulting a public servant from discharging duty, said a source at the Hare Street Police station where it was registered on Monday.
Banerjee faced protests by Left students for meeting Prime Minister Narendra Modi and allegedly "diluting the fight against the CAA".

Bhim Army Chief Azad Granted Bail With Conditions by Delhi Court
A Delhi court has granted bail to Bhim Army chief Chandrashekhar Azad in a case related to violence during anti-CAA protests at Delhi’s Daryaganj, news agency PTI reported.
While announcing the bail, Justice Lau said that Chandrashekhar should not be in Delhi for the next four weeks, citing interference in the upcoming Delhi elections.
Further, the judge also asked Azad to mark his presence with Saharanpur SHO every Saturday for the next month. The order demands Azad to depart for Saharanpur in the next 24 hours. She said that Azad to be provided escort protection for him while in Delhi for the next 24 hours.
While Azad's lawyer argued that he is not safe in Saharanpur, the judge said that Saharanpur is the only address he has and shall depart in 24 hours.

ICJ Urges Govt to Investigate Into Use of 'Unlawful' Force by UP Police
The International Commission of Jurists (ICJ) on Wednesday, 15 January, released a statement saying that the Indian government should look into the “use of excessive and unlawful force by Uttar Pradesh police against demonstrators protesting the imposition of a discriminatory new law.”
Further, the statement is based on firsthand interviews with concerned witnesses and victims.
“The high death toll of peaceful protesters in Uttar Pradesh highlights the use of excessive force by the police, in contravention of international standards of policing and human rights. The state and federal governments must investigate any death or injury that occurs during protests by law enforcement officials and to ensure access to justice to victims and their families,” Sam Zarifi, secretary general, ICJ said.
Sikhs From Punjab Join as Anti-CAA, NRC Stir at Shaheen Bagh
Hundreds of Sikhs from Punjab on Wednesday, 15 January, joined the anti-citizenship law protesters at South East Delhi's Shaheen Bagh, demanding withdrawal of the contentious legislation.
The gathering of around 350 Sikhs from Moga, Barnala, Ludhiana, Patiala, Sangroor districts came as farmers' body Kisan Union (Ekta) (Ugraha) extended its support to the protesters.
AAP's Okhla MLA to Conduct Low-Key Poll Campaign
AAP MLA and Okhla candidate Amanatullah Khan said that he will conduct a low-key poll campaign and not take out any road show, bike rally or pad yatra in solidarity with the ongoing protests against CAA and NRC.
In a video message, the sitting MLA from Okhla said he will also file his nominations quietly as two major protests- one at Shaheen Bagh and another at Jamia Milia Islamia- are taking place in his constituency.
"I will not take out any road show, bike rally or pad yatra in solidarity with the ongoing protests against the amended citizenship act and NRC," Khan said.
Protests Held at Several DU Colleges Against CAA
A series of protests were organised in several colleges of the Delhi University on Wednesday against CAA. At Ramjas College, a group of students read out the Preamble of the Constitution.
Organisers of the protest claimed that policemen were present inside the campus and the college administration tried to stop their agitation.
However, police denied that they were present on the campus.
An official of the college administration said authorities have made it mandatory for everyone to take permission for organising events at the institution's amphitheatre.
IUML Moves Fresh Plea in SC Over CAA
The Indian Muslim league has moved a fresh plea in the Supreme Court over the amended Citizenship Act on Thursday, 16 January, CNN-News18 reported.
“Citizenship once given can’t be taken back,” the plea said, citing the Uttar Pradesh government’s crackdown on 40,000 non-Hindu migrants.
ABVP Allegedly Attacks Vishwa Bharati University Students in West Bengal
The ABVP allegedly attacked the Vishwa Bharati University students in West Bengal on Wednesday, 15 January, evening, sources told The Quint.
The students alleged that a gang entered Vidya Bhavan Boys Hostel and threatened the students, asking if they had been involved in gheraoing BJP leader Swapan Dasgupta on 8 January.
The BJP Rajya Sabha member was mobbed by Left-leaning students for nearly six hours on the campus of Vishwa Bharati in Santiniketan, where he had arrived to deliver a lecture on CAA.
'Understand the Plight of Commuters': Delhi Police to Shaheen Bagh Protesters
Amid the continuing protests at Delhi’s Shaheen Bagh, a senior Delhi Police officer told The Quint that they have been unsuccessful in persuading the protesters to move out.

CAA Petition in SC: Governor Says he Should've Been Informed First
Kerala Governor Arif Muhammed Khan on Thursday, 16 January, termed as improper the state government moving the Supreme Court against the Citizenship law without informing him first as he was a constitutional head of the state.

Delhi Court Grants Bail to Seemapuri Violence Accused
A Delhi court granted anticipatory bail to one accused - Haji Tahir, who, according to the police, had allegedly instigated a crowd to pelt stones at police personnel during a protest against Citizenship Amendment Act in Seemapuri in December 2019.
Additional Sessions Judge Sanjeev Kumar Malhotra, on Thursday 16 January, granted relief to Haji Tahir, a social worker, on furnishing a bail bond of Rs 20,000 with one surety of like amount and asked him to join the investigation as and when required by the police.

Anti-CAA Protest: Judicial Custody of 54 Extended in Muzaffarnagar Violence Case
A Muzaffarnagar court on Thursday, 16 January, extended the judicial custody of 54 people who were arrested for their involvement in violence during anti-CAA protests till 28 January, PTI reported.
Chief Judicial Magistrate Ravikant Yadav on Thursday extended the judicial custody through video conferencing.
Police has arrested 85 people in the district in connection with the arson and violence that broke out in Muzaffarnagar during protests against the amended citizenship law on 20 December last year.
Punjab Govt Set to Move Resolution Against CAA in Assembly
The ruling Congress government in Punjab is set to bring a resolution in the Assembly on Friday, 17 January, demanding scrapping of the controversial Citizenship (Amendment) Act, official sources told PTI.
A minister will move a resolution on the second day of the two-day special session of the Assembly, urging the Centre to repeal the Act, the sources said.

Azad Did Not Violate Bail Order, Clarifies Delhi Police
The Delhi Police on Friday said that Chandrashekhar Azad's visit to Jama Masjid is not a violation of his bail order.
"He has a time of 24 hours after his release from Tihar Jail yesterday, to leave Delhi. He is not holding any protest at Jama Masjid," Delhi police said after a number of people and sections of media said the Bhim Army chief breached his bail conditions.

Bhim Army Chief Azad Moves Delhi Court Seeking Modification of Bail Conditions
Bhim Army Chief Chandrashekhar Azad, who has been accused of inciting people during an anti-CAA protest at Jama Masjid on 20 December, on Friday, 17 January moved court seeking modification of the conditions imposed on him by a Delhi court while granting him bail in the case.
The court had restrained Azad from visiting Delhi for four weeks and directed him not to hold any dharna till the elections in the national capital.
The plea, filed by advocates Mehmood Pracha and OP Bharti, said Azad was not a criminal and claimed imposing such conditions were wrong and undemocratic.
Delhi LG Grants Power of Detaining Authority to Delhi Police
Lieutenant Governor Anil Baijal has granted power of detaining authority to the Delhi Police Commissioner under the National Security Act, according to a notification.
The NSA allows preventive detention of an individual for months if the authorities feel that the individual is a threat to the national security, and law and order, sources said.
In exercise of the powers conferred by sub-section (3) of section 3, read with clause (c) of Section 2 of the National Security Act, 1980, the Lt Governor pleased to direct that during the period 19 January to 18 April, the Delhi Police Commissioner may also exercise the powers of detaining authority under sub-section (2) of the section 3 of the aforesaid Act, the notification stated.
The notification has been issued on 10 January following the approval of the LG.
However, the Delhi Police said it is a routine order that has been issued in every quarter and has nothing to do with the current situation.

A Muzaffarnagar court on Saturday, 18 January, granted bail to 14 people who were arrested in connection with violence during protests against the CAA, according to PTI.
District Judge Sanjay Kumar Pachori on Friday allowed their bail pleas and directed that they be released after furnishing two sureties each of Rs one lakh each.
According to the prosecution, the accused were arrested and sent to jail for allegedly being involved in the violence that broke out during protests against the Citizenship Amendment Act on 20 December last year in the Kotwali police station area.

Thousands of people led by students from different colleges gathered in the Supermarket area in Dimapur district of Nagaland on Saturday to protest against the Citizenship (Amendment) Act, PTI reported.
With banners and placards saying, ‘We stand united against CAA,’ ‘Save Dimapur - Listen to peoples' voice’ and ‘CAA – Modi Shah vote bank,’ people from all walks of life joined the protest rally.
Addressing the gathering, the students urged people to unite and fight until the Act is revoked.
They said it is their duty to safeguard the state from the influx of illegal immigrants.

Speaking at the event to commemorate the Constitution Day on 16 January, the girl criticised the Citizenship Amendment Act (CAA), saying the legislation is the "murder of the soul of the constitution, its preamble, and the liberty, equality and fraternity".
"This act discriminates people. It is mockery of my fundamental duty to promote harmony and the spirit of common brotherhood amongst people transcending religion, region and linguistic diversities. The country is burning today," the student had said.
Women, Children Sit Near Clock Tower in Lucknow Protesting Against CAA, NRC
On the lines of Delhi's Shaheen Bagh, around 50 women along with children squatted near the Clock Tower in Lucknow's old quarters on Saturday, 18 January protesting the amended citizenship law and the planned National Register of Citizens (NRC).
Newly appointed Lucknow Police Commissioner Sujit Pandey reached the protest site and tried to persuade the agitators to end the stir, but they refused to budge.
Several reports pointed out that there has been heavy deployment of police personnel in the area and attempts are being made to evict protesters.

Anti-CAA Violence: 3 Arrested Madrassa Students Released on Bail in Muzaffarnagar
Three madrassa students held in connection with violence that took place during anti-citizenship law protests in the city last month have been granted bail on Saturday, 19 January, reports PIT.
A Special Investigation Team (SIT) that was formed to look into the cases has withdrawn serious charges against them.
The police have registered one more case against unidentified persons in connection with violence here during protests against CAA on the complaint of a commandant of the Rapid Action Force.

'Can't Do Terror Politics Just Because We Have Numbers': BJP's CK Bose
BJP leader Chandra Kumar Bose, on Monday 20 January, spoke on the Citizenship Amendment Act and the controversy surrounding the Act. Speaking to news agency ANI, he said that the BJP-led government's approach has been wrong. He said that once a bill is passed, it is binding on the states. However, he said that on cannot thrust any Act on the citizens of the country.
"I've suggested to my party leadership that with a little modification the entire opposition campaign will fizzle out. We need to specifically state that it is meant for persecuted minorities, we should not mention any religion," he said.
Further, Bose said that one cannot be abusive. "Just because we have numbers today we cannot do terror politics. Let us go to people explaining benefits of CAA," he said.
States Can't be Forced to Implement CAA: Congress
Amid a debate over the implementation of the amended Citizenship Act, the Congress on Sunday said states have the right to challenge the Centre and cannot be "forced" to implement the "unconstitutional law" till the petition in the Supreme Court is decided.
Congress' chief spokesperson Randeep Surjewala said in a statement that the CAA is an attack on India's Constitution and the people's movement against the act shall continue "courageously and fearlessly".

Samajwadi Party president Akhilesh Yadav TODAY called the Centre's plans on NPR and NRC “anti-poor” and pitched for conducting a caste census.
Yadav has made the suggestion in the past as well. His demand now comes days after the Odisha cabinet adopted a resolution seeking revelation of caste details in the next Census.

'In Talks With Shaheen Bagh Protesters to Clear Blockade': DCP
Delhi’s South East DCP, Chinmay Vishwal said, “The high court has also passed directions to maintain law and order by the protests by Shaheen Bagh, we are also in talks with the protesters, telling them it also applies to them. We have been working on it, and we have got some success to clear the roads.”
He continued, “The response from the locals have been positive. A lot of locals have also faced problems due to the blockade, hence, even they want to clear the roads. We have also told them that as a responsible citizen they should contribute to the same.”
The police is monitoring the situation at Shaheen Bagh, he added saying that some people spread rumours to make the protesters leave.

The protesters squatted at the front gate of the Supreme Court, following which police dispersed them from the area, a police official said. One person was detained according to Live Law.
Out of 144 Petitions, 2 Are in Favour of CAA
Out of the 144 petitions listed before the Supreme Court regarding the constitutional validity of the Citizenship (Amendment) Act, two petitions, including the one by BJP leader Ashwini Upadhyay are in favour of CAA.
Meanwhile, 142 petitions argue it's a violation of Article 14 of Constitution (equal treatment of laws).
Bench Assembles, Commotion in Courtroom
As the SC bench sat for the start of hearings of the petitions against and in support of the Citizenship Act, the Chief Justice's courtroom erupted in a ruckus, due to the massive crowd present for the 144 petitions listed for hearing.
The CJI later discussed what to do about the crush of people in the courtroom with the senior lawyers.
He further said that he will convene a meeting of senior lawyers to figure out a solution.
Sibal Recommends Constitutional Bench, CJI Responds
Senior Counsel Kapil Sibal also recommended a larger bench to hear the matter. He told the court that there is also a question of whether the matter should be heard by a larger Bench. CJI Bobde responded saying, "maybe it should."
Won't Grant Stay Without Hearing Centre: CJI Bobde
CJI SA Bobde, while hearing the Citizenship Act petitions, said that he will not grant a stay order without hearing the Central government. "We are not going to pass an ex parte order without the copy being served to the Centre," Bobde said.

The Supreme Court has hinted at setting up a five-judge bench, after recommendations from Kapil Sibal and Abhishek Manu Singhvi. The court said taht it will take up the matter for interim orders in the next five weeks.

The Supreme Court also restrained all HCs from hearing pleas on CAA till it decides petitions.
