Triple Talaq is Against Women’s Dignity: Govt to SC

The government filed an affidavit saying a practice like triple talaq has no place in a secular country.

The central government opposed the practice of triple talaq in the Supreme Court, saying it is against the dignity of women and is misplaced in a secular counrty, on Friday.

The government filed an affidavit in the apex court opposing the practice of triple talaq. The Constitution gives the Muslim community rights to impose its own civil code to regulate matters such as marriage, divorce and inheritance.

“Gender equality and dignity of women are non-negotiable and we can brook no compromise,” the government said in its affidavit, reports the Hindustan Times.

Earlier this year, Shayara Bano filed a case against triple talaq, after her husband divorced her through post.

Law Commission Seeks Public Opinion

The Law Commission also sought public response on whether the practice of triple talaq should be abolished and whether a uniform civil code should be optional.

Amid a raging debate on uniform civil code, the law panel has sought public views on the subject to revise and reform family laws, saying the aim is to address social injustice rather than plurality of laws.

Should the practice of triple talaq be abolished, retained or retained with suitable amendments; and whether a uniform civil code should be optional are among 16 queries by the commission.
